TEMPORARY EMPLOYEE AGREEMENT

A temporary employee agreement is a document used by employers to stipulate the terms of employment for a temporary hire, and to differentiate the terms of hire from other types of contracted, full time or permanent employment. The temporary employee may also negotiate certain terms of the agreement to suit their needs. Employers need to bind the temporary employee to certain restrictions and obligations, while stating the temporary nature of a certain hire. Companies and firms hire temporary employees for a variety of reasons. A business that hires mainly full time employees will inevitably face a situation where an employee requires an extended leave. A temporary employee can replace such a staff member and the temporary employee agreement would serve as their contract. In this case, temporary employee agreements would contain information stating the time period in which the job will end, if known. If the exact time frame of a full time employee's leave is unknown, the temporary employee agreement will be left open ended, but free the employer to terminate the agreement at the necessary time.

Another instance when a company or firm might need a temporary employee would be during peak business times, for instance tax accounting in April or retail employees during the holidays. The exact time frame of the peak need for help may not be definite, so a temporary employee agreement would allow the employer to terminate employment when business dies down. The form may include a specific set of duties or obligations, which upon completion, or lack of completion within a certain time frame, would lead to termination of the agreement. Most temporary employee agreements contain detailed information concerning rate of pay, privileges or benefits if applicable, dates of temporary service, and binding restrictions concerning company privacy and trade ownership. They also may include information concerning the "at will" nature of the employment depending on a particular state's labor regulations. Appropriate temporary employee agreement forms can generally be downloaded online or drafted using a state's individual guidelines and the needs of the company or firm.
